APPLICABILITY: These tour conditions apply to Tutku Tours Tourism Organization Ltd. “hereafter called TUTKU TOURS” Gaziosmanpasa Blv. Yeni Asir Ishani 3/303 Izmir - TURKEY and the Tour participant “hereafter called member”. VISAS AND DOCUMENTATION: Each member must have a valid passport. All persons are responsible for obtaining information about entry requirements and the documentation necessary to enter those countries to which they are traveling. LUGGAGE: Each member is allowed (2) pieces of luggage not to exceed 62 inches. Carry-on bags are exempted providing they fit under your seat. Cruise passengers are allowed (2) pieces of luggage, the combined dimensions not to exceed 106 inches. INSURANCE: TUTKU TOURS provides no insurance for passengers due to loss on the trip herein. Passengers are advised to obtain their own insurance for health while traveling and / or baggage loss. Insurance is also recommended to provide coverage to passengers if refunds pursuant to the final payment and cancellation clause below are unavailable due to the terms of that clause. THE PRICE & WHAT IT INCLUDES: The dollar amount shown in above itinerary includes, transfers of persons and luggage on arrival and departure between the airport and hotel or other accommodations (where indicated in the trip itinerary) and hotel accommodations on a double occupancy basis, except as otherwise specified. TIP & TAXES: Baggage handling, gratuities and hotel taxes are often included. Minimal gratuities are included in all trips. Additional taxes, security charges and other fees collected by governments, airports, airlines and other entities are not included unless specifically listed as included features. These amounts will appear on your bill and must be included with the final payment. NOT INCLUDED IN YOUR RATE: The following is a list of some major items not included in the tour rate: excess baggage charges, room service charges, items not on portions of menus reserved for TUTKU TOURS passengers, laundry, beverages, alcoholic and otherwise, items of a personal nature, airport to ship pier transfers if air transportation is not purchased as a part of a cruise package and foreign airport departure taxes. Port taxes on cruises are not included. FINAL PAYMENT & CANCELLATION: TUTKU TOURS reserves the right to decline, accept or remove, in its sole discretion at any time and for any reason, any tour member as a participant in the trip (or any optional side trip). PAYMENT SCHEDULE: Payment of the final balance is due sixty (60) days in advance of departure, regardless of when reservations are made. Credit cards are accepted, only VISA and MASTERCARD. CANCELLATION: Reservations may only be canceled by written notice sent by certified mail (return receipt requested) to TUTKU TOURS. If such notice is received no later than sixty (60) days before departure, TUTKU TOURS will accept cancellation and refund all moneys, except for a $25.00 per person non-refundable administrative fee plus applicable hotel, cruise and air cancellation fees. If such written notice is received within sixty (60) days before departure, TUTKU TOURS will accept such cancellation and refund the land portion costs it recovers from those entities paid on behalf of member only to the extent that such moneys are refunded by those entities to TUTKU TOURS. Cancellation fee of $50 (59-30 days prior to departure) or $100 (29 days or less prior to departure per person) will not be refunded. If any person is removed by TUTKU TOURS from the trip (or any optional side trip), TUTKU TOURS’s only obligation shall be to refund to such a person a fraction of the trip price, the numerator of which fraction shall be TUTKU TOURS cost for the person’s unused services and the denominator of which shall be TUTKU TOURS cost for the person’s entire trip. RESPONSIBILITIES AND LIABILITY: The responsibility of TUTKU TOURS and / or its agents is limited. TUTKU TOURS and its agents act only as agents for passenger in regards to travel whether by air, railroad, motorcoach or any other conveyance and assumes no defect, through the acts or defaults of any company or person engaged in conveying members or in carrying out the arrangements of this tour, or as a direct or indirect result of acts of God, dangers incident in the sea, or air, fire, breakdown in machinery or equipment, acts of governments or other authorities, de jure or de facto wars, whether declared or not, hostilities, civil disturbances, strikes, riots, theft, pilferage, epidemics, quarantines, medical or customs regulations or from any other causes. TUTKU TOURS can accept no responsibilities for loss or additional expenses to members due to delay or changes in schedule. Tour services included but not limited to guide services, hotel accommodations, meals and other services are furnished by third parties who are independent and do not act for or on behalf of TUTKU TOURS and with whom TUTKU TOURS has no relationship as joint venture or otherwise. Therefore TUTKU TOURS shall not be liable or responsible in any way whatsoever for any inconvenience, loss, damage or injury arising out of or in connection with such tour services, whether same shall be the result of changes in hotel accommodations, food, baggage handling, tour guiding or any other matter related thereto. All such losses or expenses will have to be borne by the passengers. Each passenger waives any claim against TUTKU TOURS for any delay, inconvenience or damage, loss of property or baggage or injury to or deaths of persons due to the acts or omissions of said third parties. Any airline / transportation company concerned is not to be held responsible for any act, omission or event during the time passengers are not aboard their aircraft or conveyances. TUTKU TOURS further reserves the right at any time to change any part of the itinerary, or the carrier, or the aircraft utilized, or the hotel accommodations utilized, or any other. The prices advertised in this itinerary are subject to change due to price increases resulting from decreases in the purchasing power of the US dollar, gasoline price increases and similar causes. In such case each passenger can be required to pay an additional amount for the trip reflecting such increase. Travel arrangements to JFK Airport or other departure points, is solely member’s responsibility. Each person is also personally responsible for any hotel expenses, theater tickets, souvenirs, gifts, clothing, glasswork, art or any and all other items of personal property or services purchased by such person. Each person making reservations for or participating in the trip described in these folders or flyers understands and agrees to all terms, conditions and limitations set forth herein. ADDITIONAL SERVICES AND FEATURES: Are those tour services and features which must be purchased as part of the complete tour package such as US departure tax, any included ground transportation and transfers, overseas baggage and handling, tour directors, some gratuities, meals where applicable, some overseas taxes and other services. All components of this tour are included in good faith. TUTKU TOURS reserves the right to cancel the entire trip (or any optional side trips offered in connection with the trip) for any reason at any time before departure of the trip, in which event the liability, if any, for TUTKU TOURS shall be limited to and liquidated by refunding to each prospective participant the moneys, if any, therefore received by TUTKU TOURS for such person’s trip which moneys have not been or should not be otherwise refunded to said person. We reserve the right to change any part of the itinerary due to circumstances beyond our control.
